It is important to remember that construction workers have the right to work in a safe workplace like any other person. Unfortunately these rights are often overlooked by even those injured at their jobs. Due to the very nature of the construction trade, workers employed on construction sites find themselves confronted with dangerous, life threatening work conditions on a daily basis. When construction workers are injured on site, they can take action against those responsible for their conditions and ensure that their rights are protected. The right to compensation for unduly suffered injury can help make a painful injury a bit less devastating.
If you were injured while working on a construction site, your financial recovery against your employer may be affected by workers' compensation laws, but remember that other parties may be legally responsible for your injuries, including third party contractors, property owners, or equipment manufacturers. Your recovery from those parties will likely not be affected by workers' compensation laws.
In some circumstances, the injured person will be able to recover damages from the construction company, which has a duty to take reasonable steps to keep public sidewalks near its construction site free from bricks and other debris. If the company fails to remove such obstructions and someone trips and falls, the company may be liable. Construction companies should also tell pedestrians they could get injured if they stray from the sidewalk. Posting a sign is usually not enough. If a company fails to place barriers and warning lamps by a building pit, for example, it may be responsible if anyone falls into it and gets injured.
For almost 40 years, Leesfield & Partners has strongly and efficiently represented victims of construction accidents. Our firm handled and settled the case of a construction worker for a substantial amount when our client was struck in the head on job site by an unknown object. When he regained consciousness he saw several concrete cores on the ground. The case was brought against the subcontractors responsible for drilling concrete for railings. In another construction site matter, client met his untimely death when he lost his balance, fell through an open staircase and struck his head. Our firm brought a suit for failing to provide fall protection and received a significant award. Our firm represented a construction worker who was burned by hot tar that spilled on roof of a new residence and dripped on him through an open skylight. This case was settled for a substantial amount.
Leesfield & Partners also represented a 16-year-old plaintiff who was immediately electrocuted when touching a metal pole from inside because the internal wiring had come loose. Our firm obtained a $1,265,000 settlement. In another electrocution case, our firm reached a settlement of $1,135,000 when it represented the parents of a 12 year old boy who was electrocuted to death because of improperly wired boat lift. The electrician's license was revoked following this death. More recently, a gas leak from an improperly capped piping ignited our client's hotel room when the light switch was turned on, resulting in an explosion with third degree burns to both newlyweds resulting in the untimely death of the bride. Our firm reached a settlement of $3,250,000. For a complete list of the firm's representative results, go to our Verdicts and Settlements section.
